Announcement: Data Marketplace Policy Update for Upcoming State Law Changes (3/6/24)

On March 31, 2024, the state of Washington’s My Health My Data Act (MHMDA) and Nevada’s Consumer Health Data Privacy Law (CHDPL) will become effective. The consent requirements for sharing and selling data are extremely difficult to meet and will curtail the ability of many businesses to use personal data covered by these laws for advertising.

While LiveRamp's Data Marketplace Data Policy already prohibits data defined by state law as “sensitive” and requiring consent, it will be amended, effective March 31, 2024, to expressly prohibit any consumer data covered by Nevada’s CHDPL and Washington’s MHMDA (the term "consumers'' encompasses both state residents and individuals whose data is "collected" in the state).

Required Actions for Data Sellers

By March 31, 2024, data sellers must remove from the Data Marketplace any data covered by Washington’s MHMDA OR Nevada’s CHDPL by disabling those by disabling those segments. It is the responsibility of data sellers to determine what meets this definition and comply with all privacy laws and the Data Marketplace Data Policy by March 31, 2024.  If LiveRamp becomes aware of any segments that do not comply with the new laws, LiveRamp will remove those segments from the Data Marketplace and notify the seller of their non-compliance with contractual obligations.
